ADVERTISING TERMS & CONDITIONS

Net payments are due by the 20th of the month following publication.

All local rates are net and non-commissionable.

All advertising requires prepayment until credit has been established. Political and going out of business ads require prepayment regardless of credit standing. Outstanding balances are payable in full prior to publication.

Publisher is not bound by any terms or conditions, printed or otherwise, appearing on order blanks, advertising forms, or copy instructions when in conflict with these terms and conditions.

Publisher reserves the right to reject, edit, or cancel any advertisement at any time.

Position requests honored as layout permits; no specific section can be guaranteed unless a position premium of 20% is paid. In no event will adjustments, reinsertion or refunds be made because of the position in which an advertisement has been published. No orders accepted on a position or omit basis.

Advertising simulating editorial matter must carry the word "Advertisement".

Publisher reserves the right to revise rates. Contract advertisers will be informed in advance by letter of any changes in or additions to this rate card.

Claims regarding errors in an advertisement must be made within 30 days of publication. Claims regarding billing errors must be made within 90 days of date in question.

The inadvertent omission of an advertisement will be adjusted only by full cancellation of the charge for the advertisement.

Adjustment for error will be made only for the area of the ad involved and in proportion to lack of service to the advertiser. On multiple insertions, credit for errors will not be given after the first insertion. Advertising placed on a no-proof basis, including alterations submitted after deadline, is done at the advertiser's risk. In no event, shall Publisher be liable for any error, for which it may be responsible, beyond liability for the cost of the advertisement.

Advertising taken over the telephone is accepted at the advertiser's risk.

All property rights, including any copyright interest to any advertisements, photographs, artwork and/or typography produced by the Publisher shall be the property of the Publisher. No such ad or any part thereof may be reproduced without the prior written consent of the Publisher.

Orders for discontinuance of advertisements should be in writing. Oral orders to discontinue will not be recognized where, through oversight, advertisements are allowed to run.

All advertising copy requiring a proof must be in the hands of the Publisher 2 hours prior to regular deadline. Proofs are for reviewing copy only; changes in composed ads may require additional production charges. No proofs on ads submitted after deadline.

We operate in an electronic environment. Any ad that is sent as a slick will be scanned in. To ensure the quality of your submission, electronic files are highly recommended.

Memo Bills: Will be furnished upon request along with tear-sheets for collection of advertiser's co-op advertising.

The advertiser/agency agrees to indemnify and hold the Publisher harmless for any loss or expense for claims arising out of the publication of copy submitted by the advertiser. This includes, but is not limited to, claims for libel, invasion of privacy, plagiarism, copyright infringement and trademark infringement.

The Publisher will not be liable for failure to publish any advertisement.

Orders submitted by agencies and advertisers that contain incorrect rates or conditions will be inserted and charged at the regular schedule of rates in force. Thus, failure to submit an order that corresponds in price to the rate card will be regarded only as a clerical error and advertising will be inserted without further notification.

All retail display advertising expenditures are credited toward fulfillment of the advertiser’s dollar volume (revenue) contract. These dollars are net dollars, after all discounts, credits and advertising agency commissions have been deducted.

The Publisher will not be responsible for advertiser’s material left thirty days after publication.
